These terms cover the Digital Underground store and the Developer Marketplace at digitalundergroundstore.com. By using the site you agree to them. Digital Underground is based in Ontario, Canada.
Buying from the store
- Checkout, payment, delivery and refunds are handled by Gumroad. Refunds follow Gumroad's terms and refund policy and any refund terms shown on the product page.
- Prices are shown before you buy. "Pay once" means there is no subscription: you pay once for the product version you bought.
- Your purchase gives you a personal licence to use the product. Please don't resell or redistribute it unless the product page says you can.
- Free downloads are provided as they are.
- If something doesn't work, contact us through support and we'll try to help.
EU right of withdrawal: If you are a consumer in the European Union or UK, you normally have a 14-day right to withdraw from a distance purchase. By buying a digital product and starting the download or streaming straight away, you ask for immediate delivery and agree that you lose that right of withdrawal once delivery begins. This does not affect refunds offered under Gumroad's policy or your rights if a product is faulty or not as described.
Developer Marketplace
- Listing is free. Buyers pay makers directly on the maker's own checkout (Gumroad, Stripe, an app store or their website). We are not part of that sale and don't handle those payments or refunds.
- Every listing is reviewed. Some go live after automatic checks; others wait for a human review.
- You may only list things you own or have the right to sell. No illegal content, malware, scams, phishing, spam, hateful content, or anything that infringes someone else's rights.
- You are responsible for your listing being accurate and for your product and its support.
- We can refuse, edit the display of, or remove any listing, and close accounts that break these terms, at any time.
- By listing, you allow us to show your listing's name, text, images and video on the site and in posts promoting the marketplace.
General
- The site is provided "as is". To the extent the law allows, we aren't liable for indirect losses or for third-party products listed on the marketplace.
- Nothing in these terms limits rights you have under consumer law where you live.
- These terms are governed by the laws of Ontario and Canada.
- We may update these terms; the date at the top shows the latest version.
